Terms of Service
Effective Date: January 1, 2025
These Terms of Service ("Terms") govern your access to and use of the Currently Health Healthcare Data Integration Platform ("Platform") operated by Currently Health ("we", "us", or "our").
By accessing or using the Platform, you agree to be bound by these Terms.
1. Platform Description
Currently Health provides a healthcare data integration platform enabling organizations to ingest, process, validate, transform, and deliver healthcare data across systems. Services include HL7 message processing, FHIR transformation, data quality analytics, and facility management.
2. Account Registration
- You must provide accurate, current, and complete information at registration.
- You are responsible for maintaining the confidentiality of your account credentials.
- You must notify us immediately of any unauthorized access to your account.
- A single person or organization may not maintain more than one account.
3. Acceptable Use
You agree not to:
- Use the Platform for any unlawful purpose
- Attempt to gain unauthorized access to any portion of the Platform
- Interfere with or disrupt Platform infrastructure or operations
- Reverse engineer, decompile, or disassemble any part of the Platform
- Share credentials or permit unauthorized account access
- Upload or transmit malicious code or harmful content
- Violate any applicable healthcare regulations, including HIPAA
4. Healthcare Data & HIPAA Compliance
- The Platform processes Protected Health Information (PHI) as a Business Associate under HIPAA.
- A Business Associate Agreement (BAA) must be fully executed before any PHI is processed through the Platform.
- You are responsible for ensuring your use of the Platform complies with all applicable healthcare regulations.
- We maintain HIPAA-compliant security controls including encryption, access controls, and audit logging.
5. Intellectual Property
- The Platform, including all software, content, and documentation, is owned by Currently Health.
- You retain full ownership of your data processed through the Platform.
- We grant you a limited, non-exclusive, non-transferable license to use the Platform for the duration of your subscription.
6. Service Availability
- We target 99.9% uptime for the Platform.
- Scheduled maintenance will be performed with advance notice where possible.
- We are not liable for downtime resulting from factors outside our reasonable control.
7. Fees & Payment
- Fees are determined by your selected plan and usage tier.
- Payment terms are specified in your subscription agreement.
- We reserve the right to modify pricing with 30 days' written notice.
8. Termination
- Either party may terminate with 30 days' written notice.
- We may suspend access immediately upon a material violation of these Terms.
- Upon termination, you may request an export of your data within 30 days.
9. Limitation of Liability
To the maximum extent permitted by applicable law, Currently Health's total liability shall not exceed the fees paid by you in the twelve (12) months preceding the claim.
10. Governing Law
These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles.
11. Changes to Terms
We may update these Terms periodically. Material changes will be communicated via the Platform or by email no fewer than 30 days before taking effect.
